The Ministry of Commerce and Industry obligated car dealerships in the Kingdom to compulsorily inspect the car before finalizing the sale procedures to the consumer, inform the customer of all specifications or any defects present in it, and sign this inspection officially.

The Ministry stressed the need to implement the regulations for recalling vehicles and their accessories, in the event that defects appear in the product itself, as a mandatory measure taken by the manufacturer and its local agent in the event that a defect appears in any product. This is done through the manufacturing company or through a government agency in the Kingdom, the country of origin, or any other country, according to the requirements mentioned.

And she warned of the need to oblige the manufacturer and its local agent to inform the Ministry in writing of any recall of a defective product for a period not exceeding ten days from the date of the start of the recall process, and to open the recall file immediately, and not to close the recall file except with permission from the Ministry, so that the notification includes specifying the types covered by the recall and the number of products. Which were imported and sold in the Kingdom of each type, and a description of the defective part produced and the reasons for the existence of the defect and the dangers that the defect may lead to.

It also obligated all companies in the regions of the Kingdom within a period not exceeding ten days from the date of the start of the recall process, and this includes the name of the manufacturing company and its logo, the name of the local agent and its full address, the name of the product, the country of manufacture, and a description of the defect.

The ministry indicated that the manufacturing company or its local agent is obligated to recall, repair or replace the defective part of the product free of charge and without regard to the warranty period, and if the user’s residence is more than 80 km from the nearest authorized workshop to the local agent, then the local agent is obligated to all transportation costs or sending technicians. The user’s residence, and the local agent is obligated to provide the Ministry with a monthly report on what was accomplished during the recall process, so that the report includes the number of products that were recalled and the defect for which it was recalled was fixed.

The Ministry instructed the commitment of the local agent to receive and handle user complaints with care, and that in the event of a recurrence of the defect three times, the manufacturing company is notified, and a copy of the communication is sent to the Ministry within a period not exceeding one week from the date of submitting the last complaint.

The Ministry indicated that it is conducting an investigation with the local agent and the manufacturing company in the event that it receives a number of complaints, not less than three, about a specific defect in a product, without prejudice to the penalties stipulated in the Commercial Agencies Law, so that the defect mentioned in this regulation is considered commercial fraud according to According to the provisions of Articles 3 and 6 of the Anti-Commercial Fraud Law, if the factory or the local agent does not recall the product, the system will be applied to them, with the right of the Ministry to stop granting the international certificate of conformity from the country of origin of the defective product, until evidence of compliance with the provisions of this regulation is submitted and the commercial fraud is lifted. and the defect on the product within the prescribed period, without prejudice to the right of the aggrieved party to compensation for the actual damages incurred as a result of that defect in the product.
